Welcome to Smile Baby! The terms "we", "us" and "our" refer to Smile Baby, a business owned and operated by Sumit Kumar (proprietor). Smile Baby operates this store and website (smilebaby.in), including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Smile Baby is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products in our online store. However, colours or product appearance may differ slightly from how they appear on your screen due to your device and its settings.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any product that we offer to any person or region.
Our baby products must be used under adult supervision at all times. Please read and follow the instructions and age guidance provided with the product.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Smile Baby reserves the right to accept or decline your order. Your order is accepted when you receive an order confirmation from us. We may confirm your order and address by phone call, SMS or WhatsApp before dispatch.
We may cancel an order if the product is out of stock, the delivery pincode is not serviceable, there is a pricing error, or we suspect fraudulent activity. If we cancel an order, any amount paid will be refunded in full.
You can cancel your order before it is dispatched. Cancellations, returns, replacements and refunds are governed by our Cancellation, Return & Refund Policy (https://smilebaby.in/pages/refund-policy).
You represent that your purchases are for your own personal or household use and not for commercial resale.

SECTION 4 - PRICES AND PAYMENT
All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Delivery is free on all orders. The price charged for a product will be the price in effect at the time the order is placed and will be shown in your order confirmation.
Prices, discounts, coupon codes and promotions are subject to change without notice. Promotions may be governed by their own terms; if there is a conflict, the promotion terms will apply.
We accept the payment methods shown at checkout, which may include UPI, debit/credit cards, net banking, wallets and Cash on Delivery (on eligible pincodes). Online payments are processed securely by our authorised payment partners. We do not store your card details, UPI PIN or bank login details.
You represent that the payment information you provide is true and that you are authorised to use the payment method for the purchase.

SECTION 5 - SHIPPING AND DELIVERY
We deliver to serviceable pincodes across India. Orders are usually dispatched within 1-2 business days and delivered within 4-7 business days after dispatch. All delivery times are estimates and may be affected by courier delays, weather or events outside our control. SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including the Smile Baby name, logo, website design, text, graphics and our own images and videos, are owned by Smile Baby or used with permission, and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws of India.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish or otherwise use any material on the Services without our prior written consent.
Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and trademarks on the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. Such tools are provided "as is" and "as available" without any warranties or endorsement. Your use of optional third-party tools is entirely at your own risk and subject to the terms of the relevant third-party provider.
We may offer new features through the Services in the future. Such features shall also be subject to these Terms of Service.

The Services may contain links to websites operated by third parties. We are not responsible for the content, accuracy or practices of any third-party websites. SECTION 9 - RELATIONSHIP WITH SHOPIFY
Smile Baby is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Smile Baby. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Smile Baby, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Smile Baby.

SECTION 10 - PRIVACY POLICY

We may terminate these Terms or your access to the Services at any time without notice. You will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification and Governing Law) will continue to apply.

SECTION 16 - DISCLAIMER OF WARRANTIES
Except as expressly stated by Smile Baby, including in our Cancellation, Return & Refund Policy, the Services and all products are provided "as is" and "as available", without any other warranties of any kind, to the extent permitted by applicable law. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019.

SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Smile Baby and its partners, service providers, Shopify and its affiliates shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any product. Our total liability for any claim related to a product shall not exceed the amount you paid for that product.

SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless Smile Baby, Shopify and our affiliates, partners and service providers from any losses, damages or claims, including reasonable legal fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services.

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall continue in full force and effect.
